This Privacy Policy describes the collection, use, disclosure, and retention of personal information by Miller Built Realty LLC, doing business as Homes By Luke (the “Company,” “we,” “us,” or “our”), in connection with this website and inquiries submitted through it (collectively, the “Site”). References to “you” mean an individual who accesses the Site or provides personal information to the Company.
Real estate brokerage services are provided through Wayvora Realty. This Policy does not supersede privacy notices, disclosures, or contractual obligations applicable to a separate brokerage relationship or transaction, and does not govern independently operated third-party websites or services.
Categories and sources of information
We collect personal information directly from you, automatically through your use of the Site, and from service providers and analytics or advertising partners in connection with Site activity. The categories of information include:
- Identifiers and contact information: name, email address, telephone number, postal or property address, and online identifiers.
- Inquiry and transaction-related information: property details, service interests, anticipated transaction timing, communication preferences, and the contents of messages or requests.
- Internet and device information: IP address, browser and operating system information, device characteristics, access times, referring and exit pages, page views, interaction events, and diagnostic or security information.
- Marketing and attribution information: referral sources, campaign identifiers, link parameters, advertising identifiers, and information concerning interactions with advertisements or promotional materials.
- Usage and derived information: approximate location derived from technical information and inferences concerning content or service interests based on Site activity.
Information requested in a form may be necessary to process the relevant inquiry. The Site is not intended to receive government identification numbers, financial account credentials, payment card information, health information, or other sensitive personal information. Do not submit such information through general inquiry forms.
Purposes of processing
We process personal information to administer and respond to inquiries; provide requested information and estimates; communicate regarding services; maintain business records; operate, troubleshoot, secure, and improve the Site; evaluate content and campaign effectiveness; conduct analytics and advertising; detect or prevent fraud, misuse, and unauthorized activity; comply with legal obligations; and establish, exercise, or defend legal rights.
Processing for advertising and analytics is described below. A general inquiry does not, by itself, enroll you in an automated marketing text-message program.
Disclosure of personal information
We disclose personal information as appropriate for the purposes described in this Policy to the following categories of recipients:
- Service providers: vendors supporting hosting, data storage, security, communications, form processing, and Site administration. These include Cloudflare, which provides hosting, inquiry storage, and email delivery.
- Brokerage and professional recipients: Wayvora Realty and professional advisers or transaction participants to the extent relevant to your request, a service relationship, or applicable obligations.
- Analytics and advertising providers: Microsoft, Google, and Meta, as described in the analytics and advertising section below.
- Legal and protective recipients: courts, regulators, law enforcement, advisers, or other persons when disclosure is required by law or reasonably necessary to address fraud, protect rights or safety, respond to legal process, or resolve disputes.
- Business successors: parties involved in an actual or proposed merger, financing, reorganization, acquisition, or transfer of business assets, subject to applicable confidentiality and legal requirements.
Personal information may also be disclosed at your direction or with your consent. Independent third parties may process information under their own privacy notices and legal obligations.
Cookies and similar technologies
The Site and its providers use cookies, pixels, tags, browser storage, and similar technologies for authentication, security, functionality, attribution, analytics, and advertising. These technologies may be provided by the Company or by third parties and may collect information across visits or services.
Browser settings may allow you to restrict or delete cookies and stored data. Such settings may affect Site functionality and do not necessarily prevent all collection or use of information. Controls may apply only to the browser or device on which they are exercised.
The Site also uses Google Fonts. Requests for remotely hosted fonts transmit technical information, including an IP address, to Google. Additional information is available in Google Fonts’ privacy disclosures.
Analytics, session replay, and advertising
We use Microsoft Clarity, Google Analytics, and Meta Pixel for Site analysis, performance evaluation, advertising measurement, audience development, and remarketing. These services process device and online identifiers, browsing activity, referral information, and interaction or conversion events. The information processed varies according to the service, your activity, and applicable privacy choices.
Microsoft Clarity. Clarity records Site interactions and generates behavioral metrics, heatmaps, and session replays to help evaluate usability and improve content and marketing. Microsoft’s processing is described in the Microsoft Privacy Statement.
Google Analytics. Google Analytics measures traffic, engagement, referral sources, and conversion events. Information is used to evaluate Site performance and advertising effectiveness and to support audience and remarketing functions through linked advertising services. See Google’s partner-site disclosures and Privacy Policy.
Meta Pixel. Meta Pixel transmits information about Site visits and interactions to Meta for advertising measurement, audience creation, and remarketing on Facebook, Instagram, and related services. Meta may associate this information with other information it maintains, including account information. See Meta’s Privacy Policy and Cookie Policy.
Disclosures for advertising may constitute a “sale,” “sharing,” or processing for targeted advertising under applicable privacy laws, regardless of whether monetary consideration is exchanged. Applicable rights and request methods are described below. This Policy is a notice of data practices and does not itself constitute consent where separate consent is required.
Retention and safeguards
Retention periods depend on the nature of the information, the purposes of processing, the duration of a service relationship, recordkeeping obligations, and the need to resolve disputes or establish, exercise, or defend legal claims. Inquiry records, communications, brokerage records, and records maintained by third-party providers may be subject to different retention practices. Deletion from one system does not necessarily remove information from separate records or backups that may lawfully be retained.
The Site uses HTTPS encryption and access controls for administrative functions. No method of transmission, storage, or access control is completely secure, and we do not warrant that information will be protected against every unauthorized access, loss, or misuse. Nothing in this Policy limits obligations or rights that cannot be limited under applicable law.
The Company and its providers may process or store information in the United States and other jurisdictions in which they operate. Privacy laws in those jurisdictions may differ from those in your jurisdiction.
Privacy rights and requests
Subject to applicable law, eligibility requirements, and statutory exceptions, you may have rights to confirm processing; access or obtain a copy of personal information; correct inaccuracies; request deletion; obtain information about disclosures; and opt out of a sale, sharing, targeted advertising, or certain profiling. The availability and scope of these rights depend on your jurisdiction and the processing at issue.
Submit privacy requests to [email protected] or 507-216-2497. Identify the nature of your request and provide sufficient information to locate the relevant records. We may take reasonable steps to verify your identity or an authorized agent’s authority before acting. Do not include sensitive identification documents unless requested through an appropriate method. Requests are subject to applicable verification requirements, exceptions, and response periods.
If we decline a request, you may seek review by contacting the same address with the subject line “Privacy Appeal.” Where applicable, you may also submit a complaint to your state attorney general or other competent regulator. We will not unlawfully discriminate against you for exercising an applicable privacy right. Minnesota residents may consult the Minnesota Attorney General’s privacy resources.
Provider-specific controls include the Google Analytics browser opt-out add-on, Google My Ad Center, and the privacy and advertising controls described in Microsoft’s and Meta’s policies. Ad-personalization settings do not necessarily disable analytics or other processing.
Communications preferences
You may request a change to your contact preferences or ask that promotional communications cease by contacting us. To opt out of text messages, reply STOP or contact us directly. Message and data rates may apply. An opt-out does not prohibit communications required by law or necessary to administer an existing service relationship, to the extent permitted by law.
Children’s privacy
The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. A parent or guardian who believes a child has provided personal information should contact us to request review and appropriate removal.
External websites and services
Links to listing platforms, financial services, public resources, and other third-party websites are provided for convenience. This Policy does not apply to those independent services. Review their privacy notices before providing information or using their features.
Amendments
We may revise this Policy to reflect changes in our practices, services, or legal obligations. Revisions will be posted with an updated date. Any additional notice or consent required by applicable law will be provided or obtained as required.
